Illegal Immigrant Supporting Dream Act Fails in New York; Opposed By 56% of Voters

A new poll shows a majority of New York voters oppose tuition assistance for illegal immigrants. The data, collected by the Siena College Research Institute, comes days after a version of the Dream Act, doing just that, failed to pass the New York Senate. The bill provides an estimated $20 million through TAP (Tuition Assistance Program) to undocumented students:

OSC estimates that TAP awards to undocumented students would have cost $20 million if the New York State DREAM Act were in effect in the current year based on the conservative assumptions that all full-time students would apply for TAP and receive the maximum award.

The poll itself shows that, of the 56% that oppose the Dream Act, a majority of moderates, 18 to 34 year olds, and people in an "other" party also oppose the bill. 

This revelation should signal to serious lawmakers that the time has come to oppose laws that favor law-breaking over legal, tax-paying citizens. When 76% of legal New York State college students do not have access to tuition assistance, does it make sense to spend more money on "undocumented" students? The tide of discontent among U.S. taxpayers should send a signal to idealistic, left-wing politicians that think the rights of undocumented immigrants should supersede those of the American citizen.

Federal Judge Defies Eric Holder: Yes, Arizona and Kansas Can Require Voters To Prove Their Citizenship

How about coming to America the right way? After all illegal is illegal and other countries around the world don't allow a tenth of the crap illegals get away with here:

Under the oh so august leadership of Attorney General Eric Holder, the Obama administration has been doing their very best to thwart various states in their individual endeavors to implement voter ID laws. In this latest iteration of that ongoing battle, the Federal Election Assistance Commission has so far refused to help state officials in Kansas and Arizona change federal election registration forms to include proof of citizenship. 

Both states have new voter-ID measures measures that require new voters to provide a birth certificate, passport, or other documentation to prove their citizenship, while the federal registration form only requires that new voters sign a statement declaring that they are citizens. On Wednesday, a federal judge basically told the Obama administration to stop deliberately getting in the states’ way on this one, via the LA Times:

A federal judge has ruled that Kansas and Arizona should be allowed to require voters to provide evidence of U.S. citizenship, in a case closely watched by both sides dealing with the question of voter eligibility.

U.S. District Judge Eric Melgren in Wichita, Kan., ruled that the U.S. Election Assistance Commission had no legal authority to deny requests from the two states to add the citizenship requirement. In the ruling, released Wednesday, he ordered the commission to revise the national form immediately. …

“This is a huge victory for the states of Kansas and Arizona,” Kobach said in a prepared statement emailed to reporters. “They have successfully protected our sovereign right to set and enforce the qualifications for registering to vote. We have now paved the way for all 50 states to protect their voter rolls and ensure that only U.S. citizens can vote.”

“Today’s decision is an important victory for the people of Arizona against the Obama administration, assuring that only Arizona residents and not illegals vote in Arizona elections,” Arizona Atty. Gen. Tom Horne said in a statement.

“Only Arizona residents and not illegals”? Well, that of course is just ridiculous, because as we know perfectly well by now — we know, because progressives continuously tell us so — voter fraud is absolutely not a real thing. Voter-ID laws are just vacuous excuses made up by Republicans in order to maliciously disenfranchise minority voters. “Proof of citizenship” requirement? Ha! I mean, can you say “racist dog whistle”?

House Republicans Release Their “Standards for Immigration Reform”

If there's never another Republican President, this will be one of the reasons why:

Behold the long-awaited “statement of principles,” hot off the presses at today’s House Republican retreat. There are no surprises, or at least not yet: The statement’s so light on specifics, especially in the crucial final sentence, that it’s impossible to guess how bad the final deal might be.

Although if you guess “pretty bad,” you’re almost certainly on safe ground.

Standards for Immigration Reform
PREAMBLE Our nation’s immigration system is broken and our laws are not being enforced. Washington’s failure to fix them is hurting our economy and jeopardizing our national security. The overriding purpose of our immigration system is to promote and further America’s national interests and that is not the case today. The serious problems in our immigration system must be solved, and we are committed to working in a bipartisan manner to solve them. But they cannot be solved with a single, massive piece of legislation that few have read and even fewer understand, and therefore, we will not go to a conference with the Senate’s immigration bill. The problems in our immigration system must be solved through a step-by-step, common-sense approach that starts with securing our country’s borders, enforcing our laws, and implementing robust enforcement measures. These are the principals guiding us in that effort.

Border Security and Interior Enforcement Must Come First
It is the fundamental duty of any government to secure its borders, and the United States is failing in this mission. We must secure our borders now and verify that they are secure. In addition, we must ensure now that when immigration reform is enacted, there will be a zero tolerance policy for those who cross the border illegally or overstay their visas in the future. Faced with a consistent pattern of administrations of both parties only selectively enforcing our nation’s immigration laws, we must enact reform that ensures that a President cannot unilaterally stop immigration enforcement.

Implement Entry-Exit Visa Tracking System
A fully functioning Entry-Exit system has been mandated by eight separate statutes over the last 17 years. At least three of these laws call for this system to be biometric, using technology to verify identity and prevent fraud. We must implement this system so we can identify and track down visitors who abuse our laws.

Employment Verification and Workplace Enforcement
In the 21st century it is unacceptable that the majority of employees have their work eligibility verified through a paper based system wrought with fraud. It is past time for this country to fully implement a workable electronic employment verification system.

Reforms to the Legal Immigration System
For far too long, the United States has emphasized extended family members and pure luck over employment-based immigration. This is inconsistent with nearly every other developed country. Every year thousands of foreign nationals pursue degrees at America’s colleges and universities, particularly in high skilled fields. Many of them want to use their expertise in U.S. industries that will spur economic growth and create jobs for Americans. When visas aren’t available, we end up exporting this labor and ingenuity to other countries. Visa and green card allocations need to reflect the needs of employers and the desire for these exceptional individuals to help grow our economy.

The goal of any temporary worker program should be to address the economic needs of the country and to strengthen our national security by allowing for realistic, enforceable, usable, legal paths for entry into the United States. Of particular concern are the needs of the agricultural industry, among others. It is imperative that these temporary workers are able to meet the economic needs of the country and do not displace or disadvantage American workers.

Youth
One of the great founding principles of our country was that children would not be punished for the mistakes of their parents. It is time to provide an opportunity for legal residence and citizenship for those who were brought to this country as children through no fault of their own, those who know no other place as home. For those who meet certain eligibility standards, and serve honorably in our military or attain a college degree, we will do just that.

Individuals Living Outside the Rule of Law
Our national and economic security depend on requiring people who are living and working here illegally to come forward and get right with the law. There will be no special path to citizenship for individuals who broke our nation’s immigration laws – that would be unfair to those immigrants who have played by the rules and harmful to promoting the rule of law.

Rather, these persons could live legally and without fear in the U.S., but only if they were willing to admit their culpability, pass rigorous background checks, pay significant fines and back taxes, develop proficiency in English and American civics, and be able to support themselves and their families (without access to public benefits). Criminal aliens, gang members, and sex offenders and those who do not meet the above requirements will not be eligible for this program. Finally, none of this can happen before specific enforcement triggers have been implemented to fulfill our promise to the American people that from here on, our immigration laws will indeed be enforced.

As expected, per the “Youth” section, there’ll be a special path to citizenship for DREAMers but not for adult illegals. As for the final line, what sort of enforcement triggers are we talking about here? “No legalization until there’s been a measurable 50 percent drop in illegal immigration over five years” would be a trigger worth considering. “No legalization until DHS submits a border-security plan,” which is basically what the Gang of Eight prescribed, wouldn’t be. There’s a lot of devil in these details.

Sean Trende of RealClearPolitics started tweeting in total mystification after the statement was released as to why the GOP would be pushing amnesty now, of all moments. If they were dead set on doing this before the midterms, he reasoned, why not do it last year, to give conservative anger more time to cool before the big vote? Failing that, why not wait until next year, after the midterms, since no one expects the Latino vote to be decisive this fall? I have no answers to the first question but you know my answer to the second. I think Boehner’s afraid that if they wait another year, until the GOP holds the Senate as well, conservative expectations for a “tough” Republican-written law will be so high that the backlash when they fail to come through will be even more bitter than it’ll be if they do it this year. In fact, as another Twitter buddy speculated, it may be that Boehner expects so many more tea partiers in the House and Senate next year that he feels he has to act now, before they’re seated. If he waits, tea partiers might be strong enough in 2015 to block the sort of bill that his friends in the Chamber of Commerce want written. When push comes to shove, he, Ryan, and the rest of the leadership think conservative/independent anger over ObamaCare will wash away all of their sins come November, including a mortal sin on immigration. Even if they sell you out on this, they figure, you’ll still go to the polls to rebuke Obama for the millions of cancellations and higher premiums that his pet boondoggle has stuck America with. And honestly? I’m not sure they’re wrong.

Update: Good catch by Greg Sargent. There’s no special path to citizenship here for adult illegals, but neither is there anything that would preclude them for applying for green cards and citizenship later on through existing channels. In fact, Paul Ryan signaled yesterday that they would be able to apply. Go figure that the leadership didn’t want to highlight that footnote in their statement.

Washington Burger King Only Hires Mexicans

A huge sign outside a Burger King fast food restaurant in Ephrata, Washington is causing outrage because of its racist tone. The billboard reads, “Now Hiring Must Be Mexican.”

The image was posted on KFFM 1073′s website, a radio station based in Yakima, Washington, alongside a poll which asked,”I’m not exactly sure of the reasoning. Maybe none of the current staff can speak español or perhaps they need to fulfill their EEO report, I’m not exactly sure. What do you think? Do you find this sign offensive or are you okay with their honesty.”

82 per cent of the respondents to the poll say that they find the sign offensive.

It’s possible that the managers of the restaurant meant to advertise for a bilingual or Spanish-speaking employee, but their choice of words is clearly discriminatory.

The sign has also prompted outrage on the fast food giant’s official Facebook page, with some people calling for a lawsuit and others demanding that the chain be boycotted.

“Tell all of Burger King to take their company to Mexico and abide by legal hiring practices here in the good ole USA – This is NOT MEXICO,” writes Mark Berreth.

Washington D.C. Council to Vote On Giving Driver's Licenses to Illegals

The Washington, D.C., city council is scheduled to vote Tuesday on a bill that would allow as many as 15,000 illegal aliens currently living in the nation’s capital to obtain a driver's license. (See DC license bill.pdf) The council’s Transportation Committee initially voted to give illegal aliens licenses that would be identical to the licenses that the city issues to U.S. citizens and legal immigrants. The committee said it intended to do so on the grounds that “marked” licenses would “unintentionally reveal the immigration status of all District residents.”

However, the federal REAL ID Act of 2005 requires states to obtain “evidence of lawful status” before issuing driver's licenses that can be used as identification when boarding commercial airplanes or entering federal buildings.”

According to the 911 Commission Report, preventing foreigners from obtaining state-issued identification that allows them to open bank accounts and rent vehicles is a critical part of national security.

However, D.C. Council members considered it more important to provide driver's licenses to illegal aliens than assist with federal counterterrorism efforts. “If the federal government wishes to imbed immigration status into acceptable identification for federal purposes, it should create a national federal identification card, instead of co-opting the identification issued by state agencies,” the Transportation Committee report stated. “The Committee believes the potential harm to the District’s undocumented residents outweighs the requirement that the District comply with REAL ID--a requirement that has never been enforced in the eight year history of the law,” the report added.

However, the council later backed away from a direct confrontation with federal law by reluctantly agreeing to the specially marked license for illegal aliens that was initially proposed by Mayor Vincent Gray.

“A driver license, permit or identification card issued under this section shall clearly state on its face and in its machine-readable zone that it is not acceptable by federal agencies for official purposes,” the current bill reads.

Iowa Republican Steve King Will Kill Immigration Reform

There's a right way to come into this country that millions of people (including my parents) have followed and will continue to follow. People who come in illegally should not be granted favors:

There's no telling when an immigration bill will come to the House floor, what it will say, or who will support it.

Only one thing's for sure: Steve King will vote no.

And he's not alone.

The Iowa Republican has organized a small but growing number of conservatives who are committed to voting against any House immigration bill – no matter what it says – because they fear that the Senate will inevitably find a way to add "amnesty" to the equation.

King won't say how many members he's got on board, except that it reached "fairly deeply" into the GOP caucus. Lobbyists say it's somewhere between 20 and 70 members. Even at the low end of that range, it's enough to prevent any Republican-led immigration bill from passing.

King's "immigration whip team" began in January, when he learned that a group of House Republicans and Democrats were secretly negotiating an immigration bill that he was certain included a path to citizenship.

"I talked to Lou Barletta and said, 'We'd better prepare ourselves,'" he said.

The House's "Gang of Eight" has since splintered, with little chance of its carefully negotiated proposal making an impact in the broader immigration debate. But the House Judiciary Committee has readied four conservative immigration bills that make up the "piece-by-piece" solution to immigration, and the House Homeland Security Committee has completed work on a border security bill.

"I say to the sponsors, 'Paint for me a scenario by which any of these five pieces of legislation could become law without sacrificing the rule of law.' They're answer to me is, 'You're to help with that. You're to solve that,'" he said.

He solves it by saying no on everything.

King says he's supportive of the reform efforts in principle, but he says that they can only lead to a conference-committee compromise that he'd find unacceptable. "We'll lose in every scenario I can think of," he said. "There's nothing to be gained."

The core of King's "whip team" is relatively small, with Barletta and Mo Brooks, R-Ala., among them.

But Ira Mehlman, a spokesman for the Federation for American Immigration Reform, says there are a "significant number of members who are really concerned that anything that they come out with would be hijacked as a vehicle to push amnesty."

There has been no indication that the House will vote on any immigration legislation this fall beyond the statements of House Budget Committee Chairman Paul Ryan, R-Wis., who said in July that the House would vote on immigration in October. That October window of opportunity was always narrow, however, and now it is likely that lawmakers will be preoccupied with a debt ceiling showdown next month instead.

From King's perspective, that's great. "Each day that has passed without floor action has been good for the rule of law and good for the rule of sovereignty," he said.

The Senate bill that passed in June included a 13-year path to citizenship for unauthorized immigrants that met certain criteria. It has been widely rejected by the House, with Speaker John Boehner instead seeking a "piece-by-piece" approach to the issue.

Speaking last Wednesday at the Center for American Progress (CAP), Democratic Leader of the House Nancy Pelosi became a little confused at one point, stumbling over her words and flipping through her notes while referencing one of the founding documents of the United States. Rep. Pelosi was recalling an early women's rights convention held in Seneca Falls, New York 165 years ago. 

"And so, it was 165 years ago, 165 years ago. Imagine the courage it took for those women to go to Seneca Falls and do what they did there, to even leave home without their husband’s permission, or father’s, or whoever it was. To go to Seneca Falls, and to paraphrase what our founders said in the Constitution of the United States: they said the truths that are self-evident, that every man and woman, that men and women were created equal and that we must go forward in recognition of that." 

 It is of course the Declaration of Independence and not the Constitution that contains the reference to self-evident truths: 

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.

Eric Holder Ignores Black America And Says Citizenship For Illegal Immigrants Is A ‘Matter Of Civil And Human Rights’

Illegal immigration hurts Blacks esp. due to the high unemployment rate and minorities being on the lower end of the skill spectrum due to lack of education, the breakdown of the family and poverty. But sadly naive and ignorant black Americans will still support a half-black president (and his Stepin Fetchit attorney general Eric Holder) who openly supports illegal immigrants because their Godless, white, liberal massahs tell them to:

During an April 24 address to the Mexican American Legal Defense and Educational Fund (MALDEF), Attorney General Eric Holder told the crowd that “creating a pathway to earned citizenship” is a critical element of any comprehensive immigration reform plan. He said that establishing legal status for the nation’s estimated 11 million illegal immigrants is a “matter of civil and human rights.”

“Creating a pathway to earned citizenship for the 11 million unauthorized immigrants in this country is essential,” Holder said to applause. “The way we treat our friends and neighbors who are undocumented by creating a mechanism for them to earn citizenship and move out of the shadows transcends the issue of immigration status.”

“This is a matter of civil and human rights,” Holder continued. “It is about who we are as a nation. And it goes to the core of our treasured American principle of equal opportunity.”

Holder said that the reform proposals under consideration in the Congress are “consistent with these basic principles.”

The Gang Of 8 Offers The Wrong Solution To Illegal Immigration, At Black Workers' Expense

Another affront to black Americans under a Democrat president, no less:

A bipartisan group of senators, known as the Gang of 8, has put together a framework for the immigration reform that supposedly America is waiting for.

Provisions of the agreement have been widely leaked and, from what I see, these senators should return to the drawing board.

If we are going to tackle immigration reform, there should be agreement at the outset on the objectives. In my view, there should be three. It should enhance the freedom, fairness and security of the nation. If not, why bother?

The Gang of 8 proposal makes no gains on any of these fronts. And on at least one front — fairness — it makes a bad situation even worse.

It seems to be the way of Washington these days to take issues that are huge and complex, devise comprehensive mega-reforms — too massive for any single person to read or grasp — and pass a new law that exchanges one set of problems for different and even bigger ones.

We just finished going through this with reforms of our financial services system and our health care system. Now we’re about to do the same with immigration.

It’s unrealistic to think that with one new law we can secure our border, deal with 11 million illegal immigrants now in the country, devise a new way of allowing skilled labor to enter the country, and create a strategy to employ unskilled foreign labor.

But Washington is trying to do it all. And it seems that another legislative disaster is waiting to happen.

A purported achievement of the Gang of 8 is an agreement between big business and unions regarding hiring of unskilled foreign labor.

As our nation buckles under the load of excessive government, the proposal involves giving Washington even more power and building yet another new government bureaucracy.

The plan calls for a new Bureau of Immigration and Labor Market Research. Why yet another new bureaucracy at a time of trillion-dollar deficits and cancelled White House tours for students?

Quotas, which can be adjusted over time and market conditions, will be set for how many visas will be permitted for unskilled foreign labor. We’ll need a new army of bureaucrats sitting in Washington to study and report on conditions of different labor markets.

The quota starts at 20,000 and can reach, over time, a ceiling of 200,000. At its peak, illegal immigration was around 500,000 people a year. So in boom times, even at full quota, we still could have illegal immigrants sneaking over the border.

Government bureaucrats not only will determine how many can be hired, but also what they can be paid. In this case, the “prevailing wage.”

Prevailing wage is a defining provision of the Davis-Bacon Act, passed in 1931 to keep unskilled black labor from competing with union workers — at the time uniformly white — on federally funded projects.

Prevailing wages are generally union wages, and they assure that taxpayers pay top dollar for government construction projects. Now, in the name of immigration reform, the prevailing-wage standard is brought, for the first time, to the private sector.

Which gets to the fairness issue. Employment set-asides designated for unskilled foreign workers, with wage levels determined by the government, are nothing but a stick in the eye to competing low-wage workers in the American market.

It so happens that today these would be black workers. At 13 percent, black unemployment now is almost double the national average. But according to an analysis by Remapping Debate, a project of the Anti-Discrimination Center in New York, unemployment among young black men with no high school diploma is 51.6 percent. Unemployment among all black men and women with no high school degree is 30 percent.

The Gang of 8 immigration reform proposal is a nonstarter. We must reject any reform that doesn’t make our nation freer, fairer and more secure.
